Legal Notice and General Terms of Use

Preamble

YouFrance, a commercial brand of the company Andarela-Travel® (Andarela-Travel being registered with the INPI under reference 4606815), is a French receptive agency and tour operator that offers, via its website www.youfrance.fr (hereinafter referred to as "the Site"), the organization and sale of tailor-made trips to France.

These General Terms of Use (hereinafter referred to as "GTU") are intended to apply exclusively between Andarela-Travel and all persons wishing to access the Site and/or use the services offered from the Site (hereinafter referred to as "the User").

Any use of the services offered via the Site automatically implies the application of these GTU. We invite you to read them carefully.

Please note that the provisions of these GTU are subject to change, particularly due to legislative and/or regulatory developments, without Andarela-Travel being held responsible. The modifications will take effect upon publication on the Site (unless otherwise indicated). The latest updated version will be available to everyone and permanently accessible on the Site by clicking on the "Legal Notice and GTU" link at the bottom of the page.

Article 1: Legal Notice

1.1. 1.3. Andarela-Travel is registered with the register of travel and holiday operators under number: IM038200009 with ATOUT-FRANCE, headquartered at 200/216 rue Raymond Losserand, CS 60043, 75680 Paris Cedex 14, France. It has financial protection from APST, headquartered at 15 avenue Carnot, 75017 Paris, France, and professional liability insurance under number AS930559 from GENERALI IARD located at 2 rue Pillet-Will, 75009 Paris, France. It also holds a T3P driver's license under number 03820081701.

 

Article 2: Definition

The Site: refers to the website andarela.fr of the company Andarela-Travel accessible from the address: www.andarela.fr

User: any internet user who browses and/or uses the services offered by Andarela-Travel from the Site.

Services: refer to all services offered by Andarela-Travel, including travel services and associated services.

Client: any internet user who, after accessing the Site, (i) subscribes to the Newsletter, and/or (ii) requests a quote, and/or (iii) accepts a proposal for travel services received from Andarela-Travel.

 

Article 3: Use of the Site

The Site is accessible free of charge from anywhere by any User with internet access. All costs incurred by the User to access the Services remain their responsibility. Likewise, Andarela-Travel cannot be held responsible for any internet connection problems attributable to any equipment and/or operator used by the User (such as reduced speed or interrupted connection).

From the Site, Users have access to the following information and/or Services:

- a varied travel offer covering most countries open to travel (free access for any internet user)
- detailed information on various products and services offered by Andarela-Travel (free access for any internet user)
- specific access to firmly or optionally subscribe to a trip, or request an online quote.

 

Article 4: Warranty and Liability

Andarela-Travel will make its best efforts to ensure access to the Site 24/7, except in cases of force majeure or events beyond Andarela-Travel's control, and subject to any necessary breakdowns and maintenance interventions required for the proper functioning of the Site.

Indeed, for the proper management of the Site, Andarela-Travel may at any time:

- suspend, interrupt or limit access to all or part of the Site, reserve access to the Site, or certain parts of the Site,
- delete any information that may disrupt its operation or contravene applicable regulations,
- suspend the Site for updates.

Andarela-Travel's liability cannot be engaged in the event of a failure, breakdown, difficulty, or interruption of operation preventing access to the Site or any of its features.

The connection equipment to the Site remains the responsibility of the User, who must take all appropriate measures to protect their equipment and their own data, especially in the event of viral attacks via the internet. Andarela-Travel cannot be held responsible, the User remaining solely responsible for the websites and data consulted.

 

Article 5: General Obligations of the Site User

The User undertakes to use the Site in accordance with the provisions of these GTU, public order, and good morals, respecting intellectual property rights and the right to image. Failure to comply with these provisions may result in Andarela-Travel holding the User liable.

By using the Services, the User and the Client declare and warrant that (a) all information provided is true and accurate; (b) they maintain the accuracy of this information; (c) their use of the Service does not violate any applicable laws or regulations.

 

Article 6: Intellectual Property

All content and materials on the Service, such as texts, graphics, videos, audiovisual works, logos, photographs, icons, images, audio clips, and software, are the property of Andarela-Travel or its licensors and are protected by copyright laws in force in France and applicable international laws. The content and materials on the Site, operated, licensed, or controlled by Andarela-Travel, may not be copied except by a User solely for personal use, and such content and materials may not be distributed, republished, downloaded, published, or transmitted in any way without the prior written permission of Andarela-Travel. Modifying or using the content or material for any other purpose would violate the intellectual property rights of Andarela-Travel and/or its licensors.

Andarela-Travel, and other trademarks and logos of Andarela-Travel that are registered trademarks, as well as the unregistered logos of Andarela-Travel, are the property of Andarela-Travel. Unauthorized use of these trademarks and logos is prohibited by law. No part of the Service or these GTU should be construed as implicitly or otherwise granting any license or right to use any trademark displayed on this Service without the specific prior written permission of Andarela-Travel for each use. The use of any trademark in connection with a link to or from any website is prohibited without the prior written permission of Andarela-Travel.

 

Article 7: Collection of Personal Data

Article 8: Applicable Law and Competent Court

These GTU are subject to French law. Any dispute concerning their interpretation and/or execution falls within the jurisdiction of the French courts.
